Unlawful Discrimination

Our Employment solicitors advise both employers and employees in relation to all types of unlawful discrimination.

How we can help

It is unlawful to discriminate (treating somebody less favourably) against anyone at work because of age, gender reassignment, being married or in a civil partnership, being pregnant or on maternity leave, disability, race, sex and sexual orientation (legally known as ‘protected characteristics’).

An employee is also protected from discrimination if they are associated with someone who has a protected characteristic or if they have complained about discrimination. There are also other areas of potential discrimination in relation to employment situations such as discrimination due to part time or fixed term employment status. Our Employment lawyers regularly advise in relation to all potential claims, and defences, to discrimination.

If an employee thinks that they might have been discriminated against in the workplace then they will need to act quickly. There are strict time limits for lodging a claim in the Employment Tribunal and it remains a requirement to firstly go through the ACAS early conciliation service.

Our Employment lawyers provide advice in relation to the prospects of successfully bringing or defending such claims and can deal with the tribunal process to conclusion on behalf of either the employer or employee, if proceedings are initiated.

We will also advise in relation to negotiating settlement, and mediation, if appropriate. Freddie Lawson, a Litigation & Disputes solicitor, and Holly Papworth, a Litigation & Disputes trainee solicitor (soon to be qualified) are both accredited Mediators.
