Trusts

Our Personal Legal Services solicitors advise upon all types of trusts, whether lifetime trusts or following death.

How we can help

Creating a trust is a means of holding money, assets or property for the benefit of designated individuals without giving those individuals immediate access to those funds, assets or property.

The usual reasons for creating a trust include protecting beneficiaries, facilitating the making of a gift when the beneficiary is too young, immature or incapable of holding the gift themselves, protecting the means-tested benefits of a beneficiary and/or disposing of assets for tax-saving purposes.

Trusts can arise in a Will or during a person’s lifetime. In the event that a person dies without a Will, and if a minor stands to inherit, then a trust would automatically arise.

There are many types of trusts and specialist advice needs to be taken to ensure that you are creating the correct type of trust for your circumstances. It is important to ensure that the trust, once created, is being administered correctly and that it is complying with all relevant tax and other legislation.

Our Personal Legal Services lawyers will advise in relation to Trustees’ duties and responsibilities and all matters relating to the creation, maintenance and winding up of a trust including such requirements as registration.
